Administrative Policy: Parking Permit Policy

Pursuant to the guidelines of the General Parking Regulation Ordinance of July 21, 2014, the following policy is established to guide the application, approval, payment of, and issuance of parking permits in the City of Warren (Ordinance 1847, Section 5).
Establishment
It is hereby established that permitted parking spaces are available within the City of
Warren in locations detailed in City Ordinance 1847, Section 5 adopted July 21, 2014.
Permit zones shall be operative from 6:00AM to 5:00PM, Monday through Friday, except New Year’s Day, Martin Luther King Jr. Day, President’s Day, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, the day after Thanksgiving, Christmas Eve, Christmas Day and New Year’s Eve (Ord. 1847, Section 5-1.B).
Nothing herein shall authorize the parking for any length of time in any location within a parking permit zone where parking is specifically prohibited by law or by any ordinance of the City. It shall be unlawful to park in the on-street permit zones between the hours of 3:00 a.m. and 6:00 a.m. all days (Ord. 1847, Section 5-1.B)
The operator of every vehicle, when parking in the permit parking facilities, shall park such vehicle wholly within a marked space with the foremost part of the vehicle headed into the parking space (Ord. 1847, Section 5-3).
A Monthly and weekly passes are provided for in certain parking zones and facilities operated by the City. Rental rates shall be as set by resolution of Council. Monthly and weekly rental rates are payable in advance. If payment is made after the fifth day of the contracted period, an additional charge of 10 percent shall be added for such late payment.
B Parking in permit zones and facilities shall be for contracted renters only, and vehicles shall be parked only within the marked space. Unauthorized vehicles shall be subject to fine and/or penalties under Ordinance 1847.
C Application for parking permits shall be made on forms provided by the City and shall include proof of identity, proof of residency and such other reasonable information that is deemed necessary by the City Manager to issue and control such permits. Permits shall be assigned to vehicles in a fashion deemed appropriate by the City as administratively determined by the City Manager or designee. (Ord. 1847, Section 5-4.A,B,C).
Policy
Any individual desiring to use a permitted parking space (the "Lessee") must complete an application as provided by the City under this policy and pay the required fee as established by the City's fee resolution in effect at that time. It shall be unlawful for any individual to park in a parking space which has not been properly leased.
All lease amounts are due and payable on or before the first day of the billing period.
If any account is delinquent after the last day of any monthly billing period in which a lease payment is due, in addition to other penalty provisions set forth herein, the City reserves the right to terminate any lease agreement and reassign the parking space, issue parking tickets for vehicles found to be parked in violation, and forward the account to the proper authority for collection action. Lessee shall be responsible for any and all costs associated with collecting delinquent accounts, including, but not limited to, filing fees, service charges, and reasonable attorney's fees.
In the event that a Lessee desires to terminate a lease with the City, the Lessee must notify the City prior to the first day of the billing period. Should the Lessee fail to notify the City of the Lessee's desire to terminate the lease with the City prior to the first day of the billing period, the Lessee shall be responsible for any and all charges associated with the use of the permitted parking space for the remainder of the billing period.
Permitted parking spaces are leased on either a weekly or monthly basis only. No refund or credit will be given for partial usage.
Lessee may not assign, sublet or transfer the rights granted under any parking permit. In the event that an unauthorized vehicle is parked in Lessee's parking space, Lessee shall be responsible for contacting the City of Warren Police Department to report any such misuse.
Print and electronic versions of any lease agreement must state that if an individual requires assistance with completing any forms or other reasonable accommodations as defined by the Americans with Disabilities Act (ADA) to contact the City’s ADA Coordinator at (814) 723-6300.
The Lease Agreement must state the following
1. Lessee will be assigned a parking space once the application is processed and fee paid. Space may be used for the parking of one passenger vehicle only. Enforcement will be from 6:00AM – 5:00PM, except New Year’s Day, Martin Luther King Jr. Day, President’s Day, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, the day after Thanksgiving, Christmas Eve, Christmas Day and New Year’s Eve.
2. A monthly rate will be charged according to the City Fee Schedule. Payment is due on the first day of the new monthly rental period, or if paying weekly on the first day of the weekly rental period. After the fifth day of the month, there is a 10% penalty on all delinquent accounts. After the last day of the monthly billing period in which a payment has not been, if the account is still delinquent, the City of Warren will terminate this agreement and begin issuing parking tickets to any vehicle found to be in violation. All accounts delinquent in excess of 30 days will be turned over to collections. Lessee shall be responsible for any and all costs of collection including, but not limited to, filing fees, service charges, and reasonable attorney’s fees. Any tickets issued as a result of non-payment or delinquency will not be voided or forgiven upon payment in full of any Lease amount due. In addition, a Lessee whose account is delinquent in excess of 30 days will no longer have the right to park in said space and the space may be assigned to another Lessee.
3. In consideration thereof, the Lessee agrees to pay without demand in advance to:

Checks, money orders should be made payable to City of Warren. Payments with credit /debit cards and online account transfers may be made by visiting www.cityofwarrenpa.gov/parking.
4. This Lease Agreement is automatically renewable until the Lessee notifies the City that the Lessee wishes to terminate the lease agreement. All leases must be cancelled by the first day of the monthly billing period. Lessee’s failure to cancel any lease by the first day of any monthly billing period will result in additional monthly (weekly) charges being due and payable by the Lessee.
5. Lease parking is provided on a weekly or monthly basis only. No refund or credit will be given for partial usage.
6. The Lessor reserves the right to close a parking space at any time for repair work, or as deemed necessary, by the Lessor.
7. The Lessee is required to contact the City of Warren Police Department in the event a reserved parking space is occupied by an unauthorized vehicle. If an individual space has been assigned, Lessee is not authorized to park in another reserved parking space, but will be assigned a temporary space by the Police Department.
8. This agreement may not be assigned, sublet or transferred in any manner by the Lessee.
9. Use of a parking space is at the risk of the Lessee. The Lessor is not responsible for any vandalism, theft or injury to Lessee’s property or person. Lessee hereby agrees to hold Lessor harmless from any and all claims, demands, and causes of every kind of character, including attorney’s fees, arising in favor of Lessee on account of personal injury, death, or damage to property occurring, growing out of, incident to, or resulting, directly or indirectly, from Lessee’s use of the parking facility or space provided for herein. No employee, agent or representative of Lessor may alter these conditions or increase Lessor’s responsibility.
10. All vehicles parked in leased parking spaces must be currently registered and inspected. Lessor reserves the right to tow or otherwise remove, at vehicle owner’s sole cost and expense, any vehicle which is not currently registered and inspected and is parked in a leased parking space.
11. The parking facility may not be used for storage of vehicles or other equipment. Any vehicle or equipment remaining in the facility for more than thirty (30) calendar days shall be deemed abandoned and may be removed from the facility in which event neither operator nor facility owner shall have any liability to any person for loss or damage on account of such removal. All costs incurred in removing and storing any abandoned vehicle or equipment shall be billed to the Lessee.
12. Backing into a space is not permitted in the garage or lot.
Following this list, Lessee must acknowledge that they have read the terms and conditions outline above and “hereby agree to all terms and conditions” as outlined.
